By purchasing a membership, class pack, or introductory offer, you agree to the following:

1. Studio Access

• Studio hours: 6:00am – 10:00pm.
• Access is permitted only during operating hours.
• Access credentials must not be shared.
• Unauthorised entry may result in termination without refund.

2. Memberships & Early Exit

Commitment memberships may be exited early under the following conditions:

Medical Reason

• Medical certificate required
• 7 days’ written notice

Relocation

• Proof of relocation required
• 14 days’ written notice

Early Termination Fee

• $250 cancellation fee
• 7 days’ written notice

All exit requests must be submitted in writing.

3. Introductory Offers & Class Packs

• All purchases are non-refundable unless required by law.
• Class packs are non-transferable.
• Expiry dates apply as stated at purchase.

4. Cancellations & Fees

Standard Cancellation

Members may cancel classes at any time via the booking platform.

Late Cancellation

• Less than 5 hours before class
• $5 fee

No-Show

• $15 fee

Fees are automatically charged to the card on file.

5. Payments

• Memberships may involve recurring billing.
• You authorise NUE Pilates to charge the nominated payment method for fees, penalties, and outstanding balances.
• Failure to pay may result in suspension of access.

6. Studio Conduct

Members must:

• Behave respectfully.
• Follow posted studio rules.
• Use equipment appropriately.
• Avoid damaging property.

NUE Pilates reserves the right to terminate membership without refund for serious misconduct.

7. Changes to Terms

NUE Pilates may update these Terms at any time. Continued use of services constitutes acceptance of updates.

8. Governing Law

These Terms are governed by the laws of the Northern Territory, Australia.

By booking, attending, or participating in services at NUE Pilates (“Studio”), you agree to the following:

1. Nature of Services

NUE Pilates operates primarily as a self-paced, screen-based Pilates studio.

• Most sessions are instructorless and delivered via digital or pre-recorded instruction.
• Limited instructor-led sessions may be offered at scheduled times.
• Supervision is not guaranteed outside designated instructor-led sessions.

You acknowledge that during instructorless sessions you are exercising without direct supervision and are fully responsible for your own safety.

2. Minimum Age Requirement

Participation is strictly limited to individuals aged 18 years and over.

By attending, you confirm you are at least 18 years old.

3. Health Declaration

You confirm that:

• You are medically fit to participate in Pilates exercise.
• You do not suffer from any condition that would make participation unsafe.
• You will seek medical advice if unsure of your ability to participate.
• You will immediately stop exercising if you feel pain, dizziness, discomfort, or unwell.

4. Pregnancy Acknowledgment

If pregnant, recently postpartum, or suspect pregnancy:

• You confirm you have obtained medical clearance.
• You accept full responsibility for participating.

5. Exercise Within Capability

You agree not to attempt advanced or high-intensity movements beyond your capability.

You acknowledge that during instructorless sessions, there may be no one present to correct your form.

6. Assumption of Risk

You understand that Pilates and reformer-based exercise involve inherent risks, including:

• Muscle strain or tears
• Joint injury
• Falls
• Equipment malfunction
• Aggravation of pre-existing conditions
• Serious injury

You voluntarily assume all risks associated with participation.

7. Limitation of Liability

To the extent permitted under the Competition and Consumer Act 2010 and Northern Territory law:

• NUE Pilates excludes liability for personal injury arising from recreational services where legally permitted.
• Nothing excludes rights that cannot lawfully be excluded under Australian Consumer Law.

8. Indemnity

You agree to indemnify and hold harmless NUE Pilates from any claims, damages, losses, or legal costs arising from:

• Your misuse of equipment
• Your negligent or reckless conduct
• Injury or damage caused by you to another person

9. Emergency & First Aid

You acknowledge:

• You must provide an up-to-date emergency contact.
• The Studio is not a medical facility.
• Staff (if present) may provide basic first aid only.
• During instructorless sessions, immediate assistance may not be available.

You release NUE Pilates from liability for emergency response actions taken in good faith.

10. Electronic Acceptance

By booking through Momence and attending the Studio, you agree that this waiver is legally binding.
